TERMS AND CONDITIONS OF SALE

ARTICLE 1 – Scope of the general conditions

These General Terms and Conditions of Sale (hereinafter the “GTCS” or “General Terms and Conditions of Sale”) apply to any purchase made for the event Vercors en Lumières via the e-ticketing service at https://vercors-lumieres.com/reservation (hereinafter the “Website”).
The event is organised by Orpheo, whose registered office is located at 6 Rue Paul Valérien Perrin – 38170 Seyssinet-Pariset, and registered with the Grenoble Trade and Companies Register under number 388 390 304. 

The Customer is invited to carefully read these General Terms and Conditions of Sale, which are intended to define the contractual relationship between the Customer and Orpheo, as well as the applicable conditions for the advance purchase of tickets. These terms are made available to the public in accordance with Article L113-3 of the French Consumer Code.

Confirming the order via the Website constitutes the conclusion of a final contract and implies the Customer’s full and unreserved acceptance of these GTCS, of which they acknowledge having been aware prior to confirming their purchase.

The applicable General Terms and Conditions of Sale are those in force at the time of the ticket purchase. Orpheo reserves the right to adapt or modify them at any time.

DEFINITIONS

All terms defined below shall have the following meanings:

  • “Ticket”: refers to the admission pass granting access to the Vercors en Lumières visit, regardless of its form or delivery method, purchased by the Customer via the Website. Ticket prices are listed on the Website. The applicable rate is the one in effect at the time of the order.

  • “Customer”: refers to any individual purchasing a Ticket via the Website and having accepted the GTCS under the conditions described below.

  • “General Terms and Conditions of Sale”: refers to the present terms and conditions, which set out the terms for purchasing and using Tickets.

ARTICLE 2 – Services

Orpheo provides visitors with a 1.2-kilometre marked and lit trail located in the communal forest of Bois Barbu (Villard de Lans), open to all and featuring both wooded and open sections. Visitors must stay on the marked and secured path. Booking grants the right to access the Vercors en Lumières trail, which includes 11 stops, as well as the loan of a visit device (audio guide and open headphones).

ARTICLE 3 – Access to the tour and Purchase terms

Access to the Vercors en Lumières nighttime trail is subject to the periods, days, and times indicated in the booking calendar.

Tickets for the event can be purchased:
– Online via the website www.vercors-lumieres.com, under the “Booking” section (recommended method);
– Directly at the entrance of the trail located on the Bois Barbu nordic site, on the day of the visit; in this case, the sale is considered firm and final.

The Customer may make their reservation via the e-ticketing section of the Website by selecting the desired number of Tickets at the applicable rate(s), subject to availability. Each Ticket grants a single entry for one person on the date indicated on the Ticket.

ARTICLE 4 – Prices

Unless otherwise expressly stated, the prices are those in effect on the day of booking. The prices at that time are firm and final. They are expressed in legal currency and inclusive of all taxes. The displayed prices are VAT-inclusive in euros, based on the VAT rate applicable on the date of the order; any change in the rate may be reflected in the product or service price. Orpheo reserves the right to change its prices at any time. The Customer may not make any claim if the price paid differs from the price in effect on the day of the visit due to a change in pricing rules.

Free Admission and Discounts

Free admission and discount policies are detailed online under the “Practical Information” section. No booking is required for children aged 5 and under.

ARTICLE 5 – Payment terms

Payment for Vercors en Lumières tickets is made by credit card as follows:
– Online through the e-ticketing system (credit card only);
– On-site at the trail reception (credit card only).

After verifying the order and accepting the GTCS under the conditions described above, the Customer is redirected to a secure payment server where they complete their payment using their credit card details, which include the card number, expiration date, and security code.

The order amount is debited from the Customer’s bank account upon final transaction validation on the Website. If the payment is declined by the payment centre, the transaction is automatically cancelled. All purchases are firm and final—no cancellations or modifications by the Customer are allowed once payment has been confirmed. At the end of the order process, the Customer receives a purchase confirmation email and a payment confirmation email (transaction receipt), both automatically generated by the secure payment system.

Entry will not be permitted without full payment on the day of the visit.
An invoice can be issued upon request. In the event of cancellation by the Customer, any deposit paid will not be refunded and will be retained as compensation for damages.

ARTICLE 6 – Online ticketing and E-tickets

When purchasing Tickets, the Customer (or Buyer) must provide the following information:
– Their full name, phone number, and email address;
– The selected service(s) (i.e. access to Vercors en Lumières and the desired time slot);
– The preferred date for the visit;
– The number and age of beneficiaries (for applicable pricing categories).

Ticket distribution:

Tickets ordered online are issued as e-tickets. These e-tickets must be downloaded by the Client from the confirmation email (PDF format). It is not mandatory to print the tickets; digital versions are accepted.

E-tickets purchased through the online ticketing platform are valid only for the date indicated on the ticket. They are non-refundable but may be exchangeable, subject to availability, in the event of cancellation by the organiser (e.g., due to bad weather or strong winds).

Ticket validity:

To access the “Vercors en Lumières” trail, the Buyer or ticket holder must present the ticket at the entrance. Any ticket that has been altered or damaged by the Buyer will be refused if the key information is illegible. The Client must ensure that all information on the ticket, including the barcode, is clearly readable. Any ticket that is soiled, damaged, or illegible will not be accepted and will be considered invalid.

It is not necessary to print the e-ticket, as it can be scanned directly from a smartphone. Access to a mobile or internet network cannot be guaranteed on site.

Each ticket is nominative and issued in the name of the person who made the booking. Other participants can be identified by the person who completed the purchase on the platform — the Buyer. Therefore, it is not necessary to provide information for each individual participant; only the Buyer is required to do so.

Ticket usage:

Visitors must present their ticket at the entrance of the trail. Access is granted in order of arrival for those with a valid ticket, according to the reserved time slot. Only tickets with a barcode are valid for entry. All tickets are systematically checked upon entry by scanning the barcode and, if necessary, verifying a valid ID proving the age of the Client.

Ticket cancellation:
Please note that ticket purchases for leisure activities are excluded from the right of withdrawal. According to Article L.221-28 of the French Consumer Code, all purchases are final and non-cancellable. Tickets cannot be returned, exchanged, or refunded, including in cases of loss or theft. In case of lost or stolen tickets, or ticket duplication, only the first person presenting the ticket will be considered the legitimate holder and granted access to the visit.

ARTICLE 7 – Cancellation and Refund Policy

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to ticket sales for events scheduled on a specific date or during a specific period. As such, tickets are non-refundable, including in the event of loss or theft, and may not be returned or exchanged.

Only the organiser, Orpheo, may decide to cancel the event. In such a case, the Buyer will be notified by email and will be offered a postponement or refund.

ARTICLE 8 – Modifications or Cancellations by the Organiser

In the event of adverse weather conditions that may compromise visitor safety (e.g., strong winds, heavy rain), Orpheo reserves the right to cancel the event for the affected evening. Ticket holders will then be offered the possibility to:

  • Postpone their visit to a later date, subject to availability;

  • Or request a refund.

In the event of a postponement or cancellation, Orpheo will inform Clients by email and/or text message using the contact information provided during the booking process.

ARTICLE 9 – Liability

The visitor is responsible for their own safety throughout the visit. Orpheo shall not be held liable in case of:

  • Injury resulting from non-compliance with safety instructions or departure from the marked trail;

  • Loss or theft of personal belongings;

  • Failure to follow the organiser’s instructions during the visit.

Children remain under the sole responsibility and supervision of their accompanying adult(s) at all times. The trail is not recommended for children under the age of 3 due to the duration and outdoor environment.

ARTICLE 10 – Applicable Law and Jurisdiction

These General Terms and Conditions of Sale are governed by French law. Any disputes arising from the execution or interpretation of these conditions shall fall under the exclusive jurisdiction of the courts of Grenoble, unless otherwise stipulated by mandatory legal provisions.
